Terms and Conditions for Gardening Services
These Terms and Conditions set out the basis on which our garden maintenance and gardening services are provided to residential and commercial customers. By making a booking, you agree to these terms, which are designed to create a clear and fair arrangement for both sides. They apply to a wide range of work, including routine maintenance, planting, pruning, lawn care, clearances, and related outdoor tasks offered by our gardening team.
1. Scope of service
We provide professional gardening services in accordance with the description agreed at the time of booking. The exact scope of work may vary depending on the condition of the garden, weather, seasonal factors, access, and the equipment required. Unless otherwise agreed in writing, all work is carried out during normal working hours and on a one-off or recurring basis as arranged with the customer.
These terms are intended to apply to all bookings made for gardeners Turnpike Lane, as well as to related services delivered under similar arrangements by our team elsewhere.
The use of the term Turnpike Lane gardeners in these terms is for service identification only and does not alter the general legal framework that governs our work.
2. Booking process
Bookings may be made after an initial enquiry and are confirmed only when the service details, date, estimated duration, and pricing basis have been agreed. At the booking stage, customers should provide accurate information about the property, access arrangements, parking limitations, water supply where relevant, and any known hazards. This helps us allocate appropriate time and resources for the job.
We reserve the right to decline or reschedule a booking if the information provided is incomplete, misleading, or if the requested work is outside our normal service capability. If a site visit is required before work can be confirmed, any quotation provided beforehand may be subject to revision once the garden has been inspected. A booking is not guaranteed until confirmation has been issued by us.

3. Customer obligations

We may also refuse to carry out work that is unsafe, unlawful, or likely to cause damage to property, plants, or surrounding areas.
4. Payments and pricing
Prices may be quoted as fixed fees, hourly rates, or estimated charges depending on the type of service. Unless explicitly stated otherwise, all prices are exclusive of VAT where applicable. Additional charges may apply for materials, specialist equipment, parking fees, disposal costs, urgent attendance, or extra labour required because the actual workload differs from the information supplied at booking.
Payment terms will be confirmed at the time of booking or in the invoice issued after completion. In most cases, payment is due on completion of the work unless a deposit, part-payment, or advance payment has been agreed. We accept payment by the methods notified at the point of sale, and we may withhold further work or future bookings if any invoice remains unpaid beyond the stated due date.

5. Cancellations, postponements, and missed appointments
If you need to cancel or rearrange a booking, you should give notice as early as possible. This includes cases where access is unavailable or the customer is not present when required.

We will not be responsible for any indirect loss resulting from a postponement, provided we have acted fairly and in good faith.
If a booking cannot proceed because the property is unsafe, the work requested would breach legal requirements, or the customer has failed to provide necessary access or information, we may treat the appointment as cancelled by the customer. Where a deposit has been taken, any refund or retention will be handled in line with the notice given, the amount of preparation already completed, and any non-recoverable costs.
6. Liability and limitations
We will carry out services with reasonable skill and care. However, gardening work carries inherent risks, including the possibility of minor plant damage, soil disturbance, surface scuffing, or unavoidable variation in appearance after pruning or clearance. Customers understand that living materials such as plants, turf, hedges, and shrubs may react differently depending on weather, condition, and prior maintenance.
We are not liable for losses arising from matters outside our control, including pre-existing defects, hidden decay, pest infestation, disease, poor drainage, subsidence, extreme weather, or failure of external structures. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under English law.
Gardeners Turnpike Lane work may involve the use of ladders, cutting tools, hand tools, and mechanical equipment. Where we advise that a service should not proceed due to a safety issue, our decision is final for that appointment. We are not responsible for damage caused by customer interference, third-party actions, or instructions that contradict our professional advice.
7. Waste removal and environmental compliance
Any waste generated during the service will be handled in accordance with applicable waste management laws and environmental duties in England and Wales. Unless otherwise agreed, waste collection, removal, and disposal are separate from the basic gardening service and may be charged additionally. The customer must tell us in advance if the waste includes anything other than green garden waste.
We will not remove hazardous, contaminated, or prohibited materials unless specifically permitted to do so and suitable arrangements have been made. This includes asbestos, chemicals, oil, paint, clinical waste, building rubble, electrical items, gas cylinders, and other regulated materials. Where such items are discovered on site, we may stop work immediately and request further instructions.
All waste should be presented in a safe and accessible manner. If waste must be carried through a property, across shared areas, or over protected surfaces, the customer should notify us in advance so that suitable precautions can be taken. Waste regulations require that waste be transferred only to authorised carriers and facilities, and we reserve the right to refuse any collection that would breach those obligations.
8. Materials, plants, and customer-supplied items
If we supply plants, soil, compost, turf, seeds, or other materials, the exact specification may vary according to availability and seasonal suitability. We may substitute comparable items where necessary, provided the overall quality and purpose remain reasonable. Customers should understand that natural products can vary in size, colour, and appearance and may not produce identical results each time.
Where the customer provides materials, tools, or plants, we accept no responsibility for defects, poor quality, incorrect sizing, or suitability issues unless the problem would have been obvious to a reasonably experienced gardener at the time of use. We may refuse to use customer-supplied items that appear unsafe, defective, or unsuitable for the intended task.
Any advice given about planting, pruning, lawn treatment, or seasonal maintenance is provided in good faith and based on the information available at the time. It should not be treated as a guarantee of growth, survival, flowering, or yield, as horticultural outcomes are influenced by many factors beyond our control.
9. Complaints and rectification
If you believe a service has not been completed with reasonable care and skill, you should notify us within a reasonable time after completion and provide details of the issue. We may request photographs or a further inspection so that we can assess the concern. If the complaint is justified, we may offer to return and correct the issue, provide a partial refund, or agree another fair remedy.
We will not consider a complaint valid where the alleged issue results from normal wear and tear, seasonal change, later weather conditions, third-party interference, delayed reporting, or instructions provided by the customer against our recommendation. Remedies, where available, will be limited to the value of the relevant service element and will not extend to indirect or consequential losses.
10. Governing law
These terms are governed by the laws of England and Wales. Any dispute arising from or connected with a booking, quotation, invoice, or service provided under these terms will be subject to the exclusive jurisdiction of the courts of England and Wales. If any part of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
11. General provisions
We may update these terms from time to time to reflect changes in law, business practice, or service arrangements. The version in force at the time of booking will generally apply to that booking unless a later change is required by law. No waiver of any term shall be effective unless agreed in writing, and failure to enforce any right will not prevent later enforcement of that right.
These terms form the entire agreement between the parties in relation to the service, unless supplemented by a written quotation, invoice note, or other document expressly incorporated into the booking.
